Assembly Bill 438 is effective January 1, 2022. It blew up the long established processes school employers utilize to reduce permanent staff through layoff for lack of work or lack of funds. Although the decision to layoff remains management prerogative, school employers must negotiate the impacts of the decision in light of the new law.
