Salary Schedules: A Deep Dive
Salary schedules reside in the quieter reaches of each collective bargaining agreement, often taking a back seat to more celebrated provisions, such as employee discipline, professional development, and organizational security. Yet, as the determinant of each unit member’s wage levels, salary schedules function as the economic engine of each collective bargaining agreement. As most salary schedules largely consist of a grid containing numbers and letters, what legal issues could possibly arise? This workshop will discuss the basic legal requirements for salary schedules, court cases where salary schedules unexpectedly went awry, as well as methods for assessing the true economic value of a salary schedule beyond a single step or column. Participants are encouraged to bring their own district’s salary schedule for evaluation and scrutiny

Bargaining the Impacts of Classified Layoffs
Assembly Bill 438 is effective January 1, 2022. It blew up the long established processes school employers utilize to reduce permanent staff through layoff for lack of work or lack of funds. Although the decision to layoff remains management prerogative, school employers must negotiate the impacts of the decision in light of the new law. In this presentation, DWK will prepare you for the next best strategic steps and help answer your questions, such as how will AB 438 change the types of impacts we bargain with the classified unions? What strategies should school employers implement today to assure a successful layoff and impacts bargaining? Which sections of current collective bargaining agreements must be modified? Do we need to negotiate an approach to reducing position held by probationary classified employees?

Shine More Light on What Happens During Negotiations
District bargaining teams should broadly publicize and communicate more (online and in writing) about negotiations. What happened at today’s session? Did the union really propose 12%? What data and facts did the district team share to support their economic counter proposal? How did the district team respond to the Union’s “no staff meetings” proposal? District bargaining teams may legally address negotiations issues to a broad audience so long as the communications are accurate, non-threatening, and not used to bypass unions in order to negotiate directly with employees. During this interactive presentation, Dr. Singh and Mr. Pearl will explain how to launch/improve a communications plan, what legal rules apply, why such communications are invaluable to the board, superintendent, employees and community, and how such efforts will improve negotiations.

The Art of Thoughtful Negotiations: A playbook approach to elemental bargaining from an HR perspective
The topics at the bargaining table underwent a swift transformation in March 2020 to novel topics never before discussed at the table. In many ways, employers and unions shared common interests involving health and safety, although not without differences. And even now, almost two years later, the parties agree on many controversial issues such as vaccines, testing and masks. Assuming that most COVID-related issues have been resolved, will issues and disputes at the bargaining table revert to the “before times,” or have labor relations undergone an existential transformation? We can assume that compensation, in all its forms, and benefits will remain front and center, but in what way? Will attraction and retention of staff be front and center for school employers? Negotiation And Effective Documentation Of Disciplinary Issues
The certificated employee discipline and dismissal procedure has been the subject of widespread notoriety, as well as one high-profile legal challenge (the Vergara case). Although these procedures are dictated by the Education Code, there are disciplinary and dismissal processes that are subject to collective bargaining. Districts can bargain causes and procedures for disciplinary action for certificated employees (except for dismissal), including suspensions of up to 15 days, and with classified employee unions as well. We will cover legal concepts and best practices in bargaining the causes and procedures for discipline, including grounds for discipline, progressive discipline, due process, Skelly hearings, and hearing procedures
